The Criminal Code Amendment Act 2007 (the “Act”) was developed by the Child Online Protection Task Group with the assistance of a separate working group, comprised of private sector stakeholders including cell phone and Internet Service Providers (the “Internet Industry”). This group includes:
The Internet Industry together with the Ministry of Energy, Telecommunications & E-Commerce developed the ‘Bermuda Internet Industry Code of Practice’ as part of this child online protection initiative.
The aims of the Code of Conduct include -
- providing guidelines to the Internet Industry to ensure compliance with their legal obligations and promote the adoption of responsible processes and procedures for dealing with issues regarding hosted content;
- providing a clear, efficient and responsible self-regulatory hosted content assessment regime in regard to the provision of mobile content, in particular to ensure that reasonable steps are taken by mobile carriers to protect young people from viewing mobile content that is not suitable for them; and
- promoting customer confidence in and encouraging the use of the Internet.
Members of the Internet Industry have specific obligations ranging from the provision of filtering software at cost to the provision of information relating to safe Internet surfing; use of chat rooms etc.
